They govern the contractual relationship between the client and mindyourstep GmbH.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 24px; color: #1d9ea8;\">Conclusion of Contract<\/span><br \/>\n<span style=\"color: #888888;\">Unless otherwise agreed, offers from mys are valid for 30 days. A contract is only concluded upon written confirmation of the assignment by the client. Assignments can be submitted to mys via email, postal mail, personal handover, or through the automated acceptance function in BEXIO. mys reserves the right to reject assignments without providing reasons and may interrupt, shorten, or prematurely terminate an assignment if the client obstructs or prevents the fulfilment of the contract, or if the client is in default of payment.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 24px; color: #1d9ea8;\">Liability<\/span><br \/>\n<span style=\"color: #888888;\">mys executes all assignments with care, necessary quality, and discretion. However, mys accepts no liability for the outcome of its services. Any claims for damages of any kind are expressly excluded.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 24px; color: #1d9ea8;\">Data Protection and Confidentiality<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"color: #888888;\">mys places the highest importance on data protection and considers it the foundation of a trustworthy relationship with clients and customers. We respect the privacy and confidentiality of personal data, as well as personal and company-specific information made available to us as part of our mandates, to ensure their protection.<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"color: #888888;\">mys implements appropriate and suitable technical precautions and security measures to protect data against unauthorized access, modification, disclosure, or deletion. All information from client projects is treated with absolute confidentiality and the utmost care. This also includes that no data will be shared with third parties without explicit consent.<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"color: #888888;\">Typically, we collect data from the following categories: resumes\/CVs and contact details, including interview notes or third-party comments. The collection of personal and confidential data at mys is governed by the following principles:<\/span><\/p>\n<ul>\n<li><span style=\"color: #888888;\">By submitting a resume or other data to mys, the individual consents to the inclusion of their data in our database.<\/span><\/li>\n<li><span style=\"color: #888888;\">mys strives to establish a trustworthy and long-term relationship with clients and customers in order to provide long-term support if needed. Consent to data storage can be withdrawn at any time, and data deletion can be requested.<\/span><\/li>\n<li><span style=\"color: #888888;\">mys is the sole owner of the personal data and uses it exclusively for consulting purposes within the legally permissible or required framework.<\/span><\/li>\n<li><span style=\"color: #888888;\">Data from client projects will be deleted or destroyed 12 months after completion.<\/span><\/li>\n<li><span style=\"color: #888888;\">As data traffic security cannot be fully guaranteed, mys assumes no liability for resulting damages. In particular, mys assumes no liability for the actions or negligence of third parties that may alter, delete, or otherwise damage data.<\/span><\/li>\n<\/ul>\n<p style=\"font-weight: 400;\"><span style=\"color: #888888;\">We also refer to the separate privacy policy listed on our website.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 24px; color: #1d9ea8;\">Cancellation Conditions<\/span><\/p>\n<ul>\n<li style=\"text-align: left;\"><span style=\"color: #888888;\"><em>Consulting:<\/em> If the client terminates a consulting project prematurely, all expenses incurred up to that point, plus 50% of the outstanding agreed expenses, are payable.<\/span><\/li>\n<li style=\"text-align: left;\"><span style=\"color: #888888;\"><em>Board &amp; C-Suite:<\/em> If the client terminates a consulting project prematurely, all expenses incurred up to that point, plus 50% of the outstanding agreed expenses, are payable. Once the program has started, all amounts stated in the offer are due, even if the program is terminated early. For health reasons or extended absences, the program may be paused, but for no longer than 3 months.<\/span><\/li>\n<li style=\"text-align: left;\"><span style=\"color: #888888;\"><em>Career Cycle Management and Leadership &amp; Talent Development:<\/em> After a non-binding and free initial consultation, the amounts stated in the offer are due upon program start, even if the program is terminated early. For health reasons or extended absences, the program may be paused, but for no longer than 3 months.<\/span><\/li>\n<li style=\"text-align: left;\"><span style=\"color: #888888;\"><em>Potential Development and Management Assessment:<\/em> If cancelled less than 14 days before the agreed date of the Potential Development procedures and\/or Management Assessments, 50% of the costs will be charged. If cancelled less than 7 days before the start, the full amount as per the written offer will be charged.<\/span><\/li>\n<li style=\"text-align: left;\"><span style=\"color: #888888;\"><em>Training:<\/em> If cancelled less than 45 days before the training date, 50% of the seminar price will be charged. If cancelled less than 30 days before, the full seminar price will be charged. In the event of no written cancellation or no-show by individual participants, the full seminar cost is still due.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: left;\"><span style=\"font-size: 24px; color: #1d9ea8;\">Assignment and Replacement of Advisors<\/span><br \/>\n<span style=\"color: #888888;\">The client has no entitlement to the provision of the programme by a specific advisor, coach or designated contact person. MindYourStep expressly reserves the right to assign advisors at its sole discretion and to change such assignment at any time for organisational, professional or other reasons.<\/span><\/p>\n<p><span style=\"color: #888888;\">Where necessary, the programme may be continued in whole or in part by another advisor or may be terminated, without giving rise to any claims by the client. In particular, such replacement or termination shall not entitle the client to any refund, damages or other compensation, provided that the contractually agreed services have been substantially rendered or that continuation of the programme is not possible for valid reasons.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 24px; color: #1d9ea8;\">Expenses and Third-Party Costs<\/span><br \/>\n<span style=\"color: #888888;\">Travel expenses (1st class rail or CHF 0.85\/km by car), meals, or accommodation (hotel booking and choice to be made by the client) will be charged based on actual costs. Costs for third-party services such as translations, production of materials, etc., will be borne by the client or invoiced accordingly.<br \/>\nAll of this applies unless otherwise agreed in advance with the client. As a rule, mys includes potential expenses in its offers, so the client incurs no additional costs.<br \/>\n<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 24px; color: #1d9ea8;\">Severability Clause<\/span><br \/>\n<span style=\"color: #888888;\">Should any of these provisions or parts thereof be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a provision that most closely reflects its economic intent.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 24px; color: #1d9ea8;\">Jurisdiction<\/span><br \/>\n<span style=\"color: #888888;\">The GTC of mys are governed by Swiss law.
